These Terms of Service (“Terms”) govern your access to and use of LoanPathIQ.com, the LoanPath IQ platform, borrower pre-qualification forms, marketing partner tools, lender dashboards, lead-management tools, tracking links, notifications, and related services offered by LoanPath IQ (“LoanPath IQ,” “we,” “us,” or “our”).
By accessing or using LoanPath IQ, you agree to these Terms. If you do not agree, do not use the website or platform.
1. What LoanPath IQ Does
LoanPath IQ is a mortgage marketing, borrower-intake, lead-management, and technology platform.
LoanPath IQ helps:
- Consumers submit mortgage inquiry and pre-qualification intake forms;
- Licensed mortgage professionals, lenders, brokers, and loan officers receive and manage borrower inquiries;
- Approved marketing partners and publishers generate verified borrower-intake opportunities through approved marketing channels;
- Platform users track lead status, campaign activity, consent records, and related workflow information.
LoanPath IQ is not a mortgage lender, mortgage broker, loan servicer, creditor, loan originator, real estate broker, financial advisor, credit repair organization, or legal advisor unless expressly stated in a separate written agreement.
2. No Lending Services or Loan Approval
LoanPath IQ does not make loans, fund loans, approve loans, underwrite loans, lock interest rates, set loan terms, determine eligibility, or provide loan advice.
Any mortgage-related discussions, pre-qualification decisions, pre-approval decisions, credit decisions, underwriting decisions, loan terms, interest rates, fees, closing costs, or approvals are handled by licensed mortgage professionals, lenders, brokers, loan officers, or financial institutions.
Submitting information through LoanPath IQ does not guarantee:
- Loan approval;
- Pre-approval;
- Pre-qualification;
- A particular interest rate;
- A particular monthly payment;
- A particular loan amount;
- Any loan product;
- Any financing terms;
- Any contact by a lender or mortgage professional.
3. Eligibility
You must be at least 18 years old to use LoanPath IQ.
By using LoanPath IQ, you represent that:
- You are legally able to enter into these Terms;
- The information you provide is accurate and submitted by you or with proper authorization;
- You will not use the platform for unlawful, deceptive, fraudulent, or abusive activity;
- If you use LoanPath IQ on behalf of a company, lender, partner, or other organization, you have authority to bind that organization to these Terms.
4. Borrower Terms
If you submit a mortgage inquiry, pre-qualification form, or borrower intake form, you agree that:
- The information you submit is accurate to the best of your knowledge;
- LoanPath IQ may process and store your information;
- LoanPath IQ may share your information with participating licensed mortgage professionals, lenders, brokers, loan officers, service providers, and platform partners as described in our Privacy Policy;
- A mortgage professional may contact you regarding your inquiry;
- Submitting a form does not create a lender-borrower relationship with LoanPath IQ;
- Submitting a form does not guarantee any loan approval, pre-approval, rate, term, or financing;
- A lender or mortgage professional may require additional information, documentation, credit authorization, income verification, asset verification, identity verification, or other materials.
You may not submit information about another person unless you have that person’s express permission.
5. Communications Consent
When you submit your phone number, email address, or other contact information, you may be asked to consent to communications from LoanPath IQ, participating mortgage professionals, lenders, brokers, loan officers, service providers, or platform partners.
Depending on the consent you provide, communications may include calls, emails, text messages, prerecorded messages, artificial voice messages, automated communications, or other communication methods permitted by law.
Consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency may vary.
You may opt out of text messages by replying STOP. You may request help by replying HELP. You may unsubscribe from marketing emails by using the unsubscribe link in the email.
Even if you opt out of marketing communications, we may still send transactional, service-related, legal, account, or security messages where permitted by law.
6. Privacy Policy
Our collection, use, disclosure, storage, and protection of information is described in our Privacy Policy.
By using LoanPath IQ, you agree to our Privacy Policy.
If there is a conflict between these Terms and our Privacy Policy regarding how personal information is handled, the Privacy Policy will control unless otherwise required by law.
7. Marketing Partner Terms
Approved marketing partners, publishers, media buyers, content creators, advertisers, and similar participants are referred to in these Terms as “Marketing Partners.”
Marketing Partners may use LoanPath IQ only after approval by LoanPath IQ.
LoanPath IQ may approve, deny, suspend, or terminate a Marketing Partner at any time.
Marketing Partners agree to:
- Use only approved campaigns, creatives, landing pages, tracking links, disclosures, and marketing materials;
- Follow all LoanPath IQ compliance guidelines;
- Use accurate and non-deceptive advertising;
- Obtain all required consumer consents;
- Avoid false, misleading, exaggerated, or unsupported claims;
- Avoid promising loan approval, guaranteed rates, guaranteed savings, guaranteed payments, or guaranteed financing;
- Avoid representing themselves as a lender unless properly licensed and expressly authorized;
- Avoid using LoanPath IQ branding in an unauthorized way;
- Avoid submitting fake, duplicate, incentivized, misleading, or unauthorized leads;
- Avoid using scraped, purchased, stolen, or improperly obtained consumer data;
- Avoid steering consumers to a specific settlement-service provider in exchange for compensation;
- Comply with applicable advertising, privacy, consumer protection, mortgage, telemarketing, email, text messaging, and data-security laws.
8. Marketing Partner Compensation
LoanPath IQ may compensate approved Marketing Partners for approved marketing activity or verified front-end borrower-intake events as described in a separate written partner agreement or dashboard settings.
Marketing Partner compensation is not based on:
- Closed loans;
- Funded loans;
- Loan amount;
- Interest rate;
- Loan terms;
- Lender compensation;
- Mortgage commission;
- Settlement-service revenue;
- Borrower selecting a specific lender;
- Any other closing-based or funding-based result.
Payable Marketing Partner events are limited to front-end, pre-loan-process activity such as:
- Approved marketing activity;
- Verified borrower inquiry;
- Completed front-end intake;
- Verified, consented, non-duplicate borrower-intake submission;
- Approved front-end borrower-intake event.
LoanPath IQ may track lender-side statuses such as 1003 completed, credit authorization received, credit pulled, documented pre-qualification, disclosure issuance, underwriting, approval, closing, or funding for lender operations and internal quality review only. These are not payable Marketing Partner events.
The availability and value of any payable event may vary by campaign, lender, state, compliance review, lead quality, and partner agreement.
LoanPath IQ may reject, reverse, hold, or deny any lead, inquiry, milestone, or payout event if we believe the submission is invalid, duplicate, fraudulent, non-compliant, unauthorized, incomplete, outside campaign requirements, or otherwise in violation of these Terms or any applicable agreement.
Nothing in these Terms creates a right to compensation unless expressly stated in a separate written agreement or approved platform payout record.
9. No Referral-Fee Arrangement
LoanPath IQ is designed as a marketing, borrower-intake, and technology platform.
Marketing Partners are not authorized to refer, steer, recommend, or affirmatively influence a consumer to select any specific lender, broker, loan officer, settlement-service provider, or mortgage company in exchange for compensation.
Marketing Partners must not describe compensation as:
- A referral fee;
- A commission on a mortgage;
- A closed-loan payment;
- A funded-loan payment;
- A rev share on lender revenue;
- A success fee based on closing;
- A fee tied to loan amount;
- A fee tied to lender compensation.
LoanPath IQ may suspend or terminate any Marketing Partner who uses prohibited language or engages in prohibited referral activity.
10. Lender and Loan Officer Terms
Lenders, brokers, lender administrators, and loan officers who use LoanPath IQ agree to:
- Access only leads assigned to them or their organization;
- Use borrower information only for legitimate mortgage-related purposes;
- Follow applicable mortgage, privacy, advertising, telemarketing, fair lending, licensing, data-security, and consumer-protection laws;
- Maintain appropriate licenses and approvals;
- Avoid false or misleading statements to consumers;
- Avoid entering inaccurate lead-status information;
- Maintain appropriate records of borrower contact and status updates;
- Protect borrower information from unauthorized access or disclosure;
- Notify LoanPath IQ promptly of any unauthorized access, suspected breach, misuse, or compliance issue.
LoanPath IQ may suspend or terminate lender access at any time for suspected misuse, non-compliance, inactivity, security concerns, or violation of these Terms.
11. Lead Statuses and Platform Data
LoanPath IQ may allow users to track lead statuses such as:
- New Inquiry;
- Duplicate Review;
- Verified Inquiry;
- Contact Attempted;
- Contacted;
- Appointment Set;
- 1003 Started;
- 1003 Completed;
- Credit Authorization Received;
- Credit Pulled;
- Pre-Qualified;
- Not Qualified;
- In Process;
- Closed;
- Lost / No Response;
- Compliance Hold.
A “Closed” status may be used for internal lender reporting, operational reporting, or campaign optimization. It must not be used as a Marketing Partner payout trigger.
LoanPath IQ may use lead-status information to operate the platform, improve services, monitor compliance, detect fraud, measure quality, and optimize campaigns.
12. Account Registration and Security
Some features require an account.
You agree to:
- Provide accurate account information;
- Keep login credentials confidential;
- Use strong passwords;
- Notify LoanPath IQ of unauthorized access;
- Accept responsibility for activity under your account;
- Not share account access with unauthorized users;
- Not bypass role-based access controls.
LoanPath IQ may suspend or terminate accounts if we believe there is unauthorized activity, fraud, abuse, misuse, or violation of these Terms.
13. Acceptable Use
You may not use LoanPath IQ to:
- Violate any law or regulation;
- Submit false, fake, misleading, or unauthorized information;
- Submit information about another person without consent;
- Scrape, harvest, or misuse consumer data;
- Upload malware, spam, or harmful code;
- Interfere with platform security;
- Reverse engineer or copy the platform;
- Circumvent access controls;
- Misrepresent your identity or authority;
- Use deceptive advertising;
- Make unauthorized mortgage, credit, lending, or legal claims;
- Sell or transfer platform access without approval;
- Use the platform in a way that harms borrowers, lenders, partners, LoanPath IQ, or third parties.
14. Compliance Monitoring
LoanPath IQ may monitor platform activity for compliance, fraud prevention, lead quality, consent verification, security, and operational purposes.
LoanPath IQ may review:
- Tracking links;
- Campaigns;
- Landing pages;
- Lead submissions;
- IP addresses;
- UTM data;
- Consent logs;
- Partner activity;
- Lender activity;
- Dashboard usage;
- Status updates;
- Notes;
- Communications metadata;
- Payout events.
LoanPath IQ may suspend campaigns, hold payouts, reject leads, restrict account access, or terminate users if compliance concerns arise.
15. Third-Party Services
LoanPath IQ may use third-party services such as hosting providers, CRM systems, analytics tools, advertising platforms, call-tracking providers, email providers, SMS providers, payment processors, compliance vendors, fraud-detection tools, and lender systems.
LoanPath IQ is not responsible for third-party services, websites, systems, content, policies, or actions.
Your use of third-party services may be governed by separate terms and privacy policies.
16. Intellectual Property
LoanPath IQ owns or licenses all rights in the LoanPath IQ website, platform, software, dashboards, designs, trademarks, logos, content, text, graphics, workflows, forms, reports, data structures, and related materials.
You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, or create derivative works from LoanPath IQ materials without written permission.
Approved Marketing Partners may use approved LoanPath IQ campaign materials only as authorized and only while in good standing.
17. User Content and Feedback
If you submit content, feedback, ideas, suggestions, campaign materials, notes, or other information to LoanPath IQ, you grant LoanPath IQ a non-exclusive, worldwide, royalty-free license to use, store, process, display, reproduce, modify, and distribute that content as needed to operate and improve the platform.
You represent that you have the rights necessary to submit the content and that it does not violate any law or third-party rights.
18. Fees and Payment
Certain platform features, lender services, partner services, or campaign services may require fees.
Fees, payment terms, billing schedules, payout rules, refund rules, chargeback rules, and related terms may be described in separate agreements, order forms, dashboard settings, invoices, or written approvals.
LoanPath IQ may withhold, offset, reverse, or delay payments where fraud, invalid activity, duplicate leads, compliance concerns, chargebacks, data-quality issues, or agreement violations are suspected.
19. Disclaimers
LoanPath IQ is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, LoanPath IQ disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and error-free operation.
LoanPath IQ does not guarantee:
- Any borrower will qualify for a loan;
- Any lender will contact a borrower;
- Any lead will convert;
- Any partner will earn a particular amount;
- Any campaign will perform;
- Any lender will approve or fund a loan;
- Any data will be error-free;
- Any platform feature will always be available.
20. Limitation of Liability
To the maximum extent permitted by law, LoanPath IQ and its owners, officers, employees, contractors, vendors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, reputational harm, or loss of goodwill.
To the maximum extent permitted by law, LoanPath IQ’s total liability for any claim will not exceed the amount paid by you to LoanPath IQ in the three months before the event giving rise to the claim, or $100 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
21. Indemnification
You agree to defend, indemnify, and hold harmless LoanPath IQ and its owners, officers, employees, contractors, vendors, affiliates, and agents from any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of LoanPath IQ;
- Your violation of these Terms;
- Your violation of any law or regulation;
- Your submitted information or content;
- Your advertising or marketing activity;
- Your misuse of borrower information;
- Your unauthorized communications;
- Your breach of any partner, lender, or user obligation;
- Any fake, fraudulent, duplicate, misleading, or unauthorized lead activity;
- Any claim that your activity violated privacy, telemarketing, advertising, mortgage, consumer-protection, or data-security laws.
22. Suspension and Termination
LoanPath IQ may suspend or terminate access to the website or platform at any time, with or without notice, if we believe:
- You violated these Terms;
- You violated an agreement with LoanPath IQ;
- You created legal, compliance, security, or reputational risk;
- Your activity appears fraudulent, abusive, or unauthorized;
- Your account has been inactive;
- Continued access could harm borrowers, lenders, partners, LoanPath IQ, or third parties.
After termination, we may retain records as necessary for legal, compliance, security, fraud-prevention, accounting, and business purposes.
23. Changes to the Platform
LoanPath IQ may modify, update, suspend, discontinue, or restrict any part of the website, platform, dashboards, forms, tracking links, campaigns, payout settings, notifications, or services at any time.
We are not liable for any modification, suspension, or discontinuation of the platform.
24. Changes to These Terms
LoanPath IQ may update these Terms from time to time.
When we update the Terms, we will revise the “Last Updated” date. If changes are material, we may provide additional notice where required by law.
Your continued use of LoanPath IQ after updated Terms are posted means you accept the updated Terms.
25. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Any disputes will be handled in the courts located in New Castle County, Delaware, unless otherwise required by law or agreed in writing.
26. Dispute Resolution
Before filing any claim, you agree to first contact LoanPath IQ at legal@loanpathiq.com and attempt to resolve the dispute informally.
Any arbitration, class-action waiver, jury-trial waiver, or other dispute-resolution language should be reviewed and approved by qualified legal counsel before being added to these Terms.
